"..on the internet, there is a punky attitude that disguises itself as sort of an electronic libertarianism"

So says internet lawyer, Ron Coleman, during an interview with John Hawkins at Right Wing News on legal issues for bloggers and blog readers. Read it, there is some good advice for all of us who read and write blogs.

Oh, I've seen people say the dumbest things and make threats that would have either landed them in jail or gotten them pounded in to the ground if it was done in person.

As to the fair use stuff, I'm sure I've violated that a number of times but my little blog doesn't attract enough attention to get nailed by the lawyers. Besides that, I always change image names before I use them on my blog.

If you give proper recognition to the creator of the work, and don't take away much of the attention, you'll generally be left alone. In this day and age one of the things that works to our benefit is that people are getting sick and tired of hearing about copyright holders complaining that people are doing a little here, a little there with their work, in a way that doesn't hurt them, but that just doesn't entirely respect their copyright. It's becoming expected that copyright holders will be more laid back about non-commercial uses.

People say lots of things that they regret later on, in person too. We're living in a society where people speak first, without any thought of the disatrous consequences of their words.

Why would we expect anything less over the Internet ?

It's harder to deny "he wrote, she wrote" than "he said, she said".

Speaking of he said, she said, this Fairness Doctrine stuff is really beginning to rise to the surface now. It's on the bottom left hand cirner of the radar screen. Although Fox is the only network on TV in any form (cable only or airwaves / MSM) that is NOT totally left wing, the democrats are complaining. It is currently about radio and TV, but (as we all knew it would) bloggers and the Internet in general are beginning to be dragged into this.
Hannity, Limbaugh, et.al., have the most to lose on radio. But if it is truly fair, the MSM has the most to lose on the boob tube. We'll see how that plays out, eh?

I can see the lawsuits now. The lawyers have got to be so happy they can't see straight.

What is fair and balanced? Who's to say? Who's going to police it?
On what will it be based? Word for word? How?

The NY Times reporter who recently stated "It's only news if we say it's news" in basic response to the silence by the MSM over the Clairol boy's affair. That's visible evidence of fair and balanced. I can't wait.
